Select Legal Issues in Fundraising: (1) Overview of State Fundraising Laws, and (2) Illegal Gambling vs. Legal Gaming

Sometimes well-intentioned and seemingly acceptable fundraising activities can run afoul of the law, even without a nonprofit knowing it is breaking the law. But ignorance of the law is no defense against an investigation into illegal fundraising activities. Come to this class to learn more about some of the fundraising-related laws that you need to know about, including:

• State regulations for registration of fundraising activities (in Missouri and other states);
• What it means to “solicit” contributions from state-to-state, and the ramifications of illegal or misleading solicitations;
• How to avoid violating do-not-call laws;
• Protection of restricted assets and endowments;
• How to tell whether  your gambling-related fundraising activity is a form of legal gaming or illegal gambling

Instructors:

Assistant Attorney General Bob Carlson coordinates all nonprofit and charity law issues for the Missouri Attorney General’s Office. He frequently investigates and litigates cases in all areas of state nonprofit law. Bob is also a past president of the National Association of State Charity Officials (NASCO) and is co-leader of the ongoing Cancer Fund multistage case – one of the largest charity fraud cases ever brought.  Bob also teaches a seminar on Nonprofit Organizations at Saint Louis University School of Law and often speaks on topics concerning state Attorney Generals’ regulation of the nonprofit sector and fundraising law.
Dan Sise, JD, joined the Nonprofit Management and Leadership Program (NPML Program) at U.M. – St. Louis in October, 2008, and serves the program’s Academic Coordinator and Community Engagement Manager.   Dan is also an instructor for the NPML Program, and teaches a class on “Legal Issues for Nonprofit Organizations” that is a required course for the NPML Certificate. A 1997 graduate of the University of Illinois College of Law, Dan is currently licensed to practice law in Missouri and Illinois.  In the course of his legal career, Dan has dealt with a wide range of issues, including regulatory compliance, insurance coverage and defense, community redevelopment, and nonprofit governance and oversight. He serves on the board of directors of a number of nonprofit organizations, including the St. Louis-Jefferson Solid Waste Management District and the Daughters of Charity Foundation of St. Louis. Prior to joining the faculty of the NPML program, Dan worked at Habitat for Humanity St. Louis where he was director of operations.
